1. Introduction

Welcome to Guthly! These Terms of Service (hereinafter "Terms") govern access to and use of our personal tracking application accessible at guthly.com and its subdomains (hereinafter the "Service").

Important: By creating an account and using Guthly, you agree without reservation to these Terms as well as our Privacy Policy. If you do not accept these terms, please do not use the Service.

• Create and track personalized progressions
• Visualize their statistics and progress

4. Account Creation and Management

4.1 Registration Requirements

• You must be at least 18 years old to use Guthly
• You must provide a valid email address
• You are responsible for the confidentiality of your credentials
• Only one account per person is authorized

4.2 Account Security

You agree to:

• Choose a strong password (if applicable)
• Not share your credentials with third parties
• Notify us immediately of any unauthorized use
• Be solely responsible for all activities performed from your account

4.3 Suspension and Termination

We reserve the right to:

• Suspend or terminate your account in case of violation of the Terms
• Delete inappropriate or illegal content
• Refuse access to the Service at any time without notice

You can delete your account at any time from Settings.

5. Acceptable Use of the Service

You may use Guthly for:

• Tracking your own data and progress
• Improving your personal well-being

5.2 Prohibited Uses

It is strictly prohibited to:

• Use the Service for illegal or fraudulent purposes
• Attempt to hack, disrupt, or overload the Service
• Extract, scrape, or collect data in an automated manner
• Impersonate another person
• Share or resell your access to the Service
• Bypass security measures or technical limitations
• Use the Service to send spam or malicious content
• Violate intellectual property rights of Guthly or third parties
• Collect personal information from other users

6. Intellectual Property

6.1 Guthly Property

All elements of the Service (source code, design, logos, texts, graphics, etc.) are the exclusive property of Guthly and are protected by French and international intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms.

6.3 Your Data

You retain all rights to the data you enter in Guthly. By using the Service, you grant us a license to process this data in order to provide you with the Service (storage, analysis, visualization).

7. Subscriptions and Payments

7.1 Offers and Pricing

Guthly offers different subscription plans. Prices are indicated in euros including VAT and may be modified at any time. Price changes do not apply to current subscriptions.

7.2 Payment Terms

• Payments are securely processed by Stripe
• Subscriptions are automatically charged at each billing cycle
• You are responsible for the validity of your payment methods
• In case of payment failure, your access may be suspended after notification

7.3 Cancellation and Refunds

• You can cancel your subscription at any time
• Cancellation takes effect at the end of the paid period
• No refund is made pro-rata for unused days
• 14-day right of withdrawal in accordance with French Consumer Code (unless you have started using the Service)

7.4 Invoicing

Invoices are automatically generated and sent by email after each payment. They are also accessible in your account.

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

9. Limitations of Liability

• The Service may be modified, suspended, or discontinued at any time
• We are not responsible for service interruptions

• We do not verify the accuracy of your data
• Statistics and analyses are provided for informational purposes

9.4 Disclaimer of Warranties

The Service is provided "as is" and "as available", without any express or implied warranties, including but not limited to:

• Warranty of merchantability
• Warranty of fitness for a particular purpose
• Warranty of non-infringement of third party rights
• Warranty of error-free or bug-free operation

9.5 Limitation of Liability

To the extent permitted by law, Guthly shall not be liable for any direct or indirect damages resulting from:

• Use or inability to use the Service
• Loss of data
• Service interruptions or errors
• Decisions made based on Service information
• Acts of third parties (hacking, etc.)

This limitation does not apply to damages resulting from gross negligence or intentional misconduct by Guthly.

10. Force Majeure

We shall not be liable for failure to perform our obligations in case of force majeure as defined by French case law (natural disasters, strikes, wars, Internet infrastructure outages, etc.).

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will take effect:

• Immediately after publication for minor changes
• After email notification and 30-day period for major changes

The "Last updated" date at the top of this page will be modified. Your continued use of the Service after modification constitutes acceptance of the new Terms.

12. Applicable Law and Jurisdiction

These Terms are governed by French law. In case of dispute, and after an attempt at amicable resolution, French courts shall have sole jurisdiction.

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Guthly.

13.2 Severability

If any provision of these Terms is held invalid or unenforceable, the other provisions shall remain in effect.

13.3 Waiver

Failure to exercise a right provided by these Terms does not constitute a waiver of that right.

13.4 Assignment

You may not assign or transfer your rights and obligations under these Terms. Guthly may freely assign these Terms in case of merger, acquisition, or sale of assets.
